Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the DesignLeap website and services operated by DesignLeap.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Courses and Services

DesignLeap offers design education courses and related services to users. By enrolling in our courses, you agree to the following:

  • Course fees must be paid in full according to the payment plan selected at enrollment.
  • Course materials, including but not limited to videos, presentations, documents, and exercises, are the intellectual property of DesignLeap and may not be shared, distributed, or reproduced without our express written permission.
  • Course access is provided for the designated period specified at the time of purchase. Extension of access may be granted at our discretion.
  • Completion of assignments and coursework is necessary to receive a certificate of completion.
  • DesignLeap reserves the right to update course content as needed to maintain relevance and quality.

3. Refund Policy

Our refund policy is as follows:

  • Full refunds are available within 7 days of enrollment if you have not accessed more than 20% of the course content.
  • Partial refunds of 50% may be issued within 14 days of enrollment if you have not accessed more than 30% of the course content.
  • No refunds will be issued after 14 days of enrollment or if you have accessed more than 30% of the course content.
  • Refund requests must be submitted in writing to our customer support team.
  • Special circumstances may be considered for refund requests outside of these parameters at our sole discretion.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of DesignLeap and its licensors. The Service is protected by copyright, trademark, and other laws both in the Philippines and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of DesignLeap.

Course materials provided to you are licensed, not sold. This license grants you a personal, non-transferable, non-exclusive right to access and use the course materials for your own personal educational purposes.

5. Student Projects and Portfolios

Projects created during courses may be used in your personal portfolio with appropriate attribution to DesignLeap. However, you retain ownership of your original work created during the courses.

By submitting projects or assignments within our platform, you grant DesignLeap a non-exclusive, royalty-free license to use, display, and showcase your work for educational and promotional purposes, with appropriate attribution to you as the creator.

6. User Conduct

As a user of our Service, you agree not to:

  • Use the Service in any way that violates any applicable local, national, or international law or regulation.
  • Impersonate or attempt to impersonate DesignLeap staff, instructors, another user, or any other person or entity.
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm DesignLeap or users of the Service.
  • Use the Service to send, knowingly receive, upload, download, or use any material that is defamatory, obscene, offensive, or otherwise objectionable.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Share login credentials with others or allow multiple users to access courses using a single set of login credentials.

7. Community Guidelines

Our platform includes community features where students can interact with instructors and other students. When using these features, you agree to:

  • Treat all community members with respect and courtesy.
  • Provide constructive feedback when commenting on others' work.
  • Refrain from posting inappropriate, offensive, or promotional content.
  • Not solicit other students or instructors for commercial purposes.
  • Report any abusive or inappropriate behavior to our moderation team.

8. Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by DesignLeap.

DesignLeap has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that DesignLeap shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Limitation of Liability

In no event shall DesignLeap, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content;

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

DesignLeap does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
